Terms of sale

1. Purpose

These terms govern the online sale, under the Foamd brand, by Thibault Alignan, sole trader (French micro-entreprise), SIRET 830 802 047 00019, 38 rue du Carignan, bât. A, apt A01, 34830 Clapiers, France (hereinafter “the seller”), of protective cases fitted with a foam cut to the configuration approved by the customer, of foam inserts on their own and of accessories.

2. Order

The customer builds their configuration, checks the dimensioned plan, the depths and, where applicable, confirms the dimensions flagged “to be confirmed”. The order covers the configuration frozen under its reference (SC-YYYYMMDD-XXXX). No paid option is pre-selected.

3. Prices

Prices are shown in euros, VAT not applicable (article 293 B of the French General Tax Code), standard delivery included. The express surcharge is shown before payment. The case is shipped directly from the manufacturing workshop: customs duties and import VAT may be charged to the customer on delivery by the carrier, depending on the value of the parcel. They are not included in the price shown.

4. Manufacturing and delivery

The case is manufactured after the seller has approved the cutting file. Indicative lead times: 5 to 6 weeks with standard delivery, 4 to 5 weeks with express. Countries delivered: all, except those where an embargo prohibits shipping (Belarus, Cuba, Iran, North Korea, Russia, Syria). Outside the European Union, import duties and taxes may be charged on arrival by the carrier. [Carrier, delivery arrangements.]

5. Right of withdrawal

In accordance with article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to foams and cases made to the customer’s specifications. Standard accessories may be returned within 14 days of receipt, [return arrangements and costs].

6. Warranties

The customer benefits from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) for two years from delivery, and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Cutting plan and fit. Before ordering, the customer checks the dimensions of their gear and the cutting plan (dimensions, depth and position of each pocket), then confirms this check when placing the order. The approved plan is the reference for cutting; approving it does not limit the applicable legal warranties. In the event of a defect or a fit problem, the customer can contact us and attach photos useful for examining their request. We review the case with them under the applicable warranties.
